02 DEC 2023 Maadhyam ADR Learning Series Session ll Part l

Maadhyam International Council for Conflict Resolution organised Session ll of Part-1 of Maadhyam ADR learning series in the national capital Delhi, emphasising upon “Enhancing Skills in Arbitration Advocacy”. The session ll of Part l series was followed by a successful Session I of Part l ADR series which focused on  “Enhancing skills in Arbitration Pleadings’.

Purpose of the ADR learning series, according to  Amarjit Singh Chandhiok, Sr, Advocate and President, Maadhyam is to demonstrate and explain to the participants  about the theory and actual legal practice in ADR. The session was divided between the law professors and practising Senior advocates so that the former can explain theory and latter the application of the same in everyday legal practice.

During his welcome address Sr, Advocate Chandhiok also emphasised on the importance of appropriate training in ADR practices and theory in the times ``when ‘Artificial Intelligence’ (AI) is penetrating more and more in professional practices."  He also maintained that  "AI should only be used as a tool and not a substitute to advocacy", therefore a training "like this would help develop skills which would enhance the knowledge about theories as well as the practices of ADR".

Guest of Honour, Hon’ble Justice Gita Mittal (Former Chief Justice, J &K High Court), during her address to the participants maintained the importance and timeliness of the ADR learning series. She pointed out that ‘arbitration’ is the need of the hour, especially for the reason that it aids in combating the issue of pendency of thousands  of cases in various Courts.

Justice (Rtd) Gita Mittal further maintained that ‘awareness and growth of arbitration’ as mode of Alternate Dispute Resolution (ADR) is of utmost importance  to meet global demands and challenges to match India’s growth as the 5th largest economy. The former Chief Justice also lauded Maadhyam for embarking on the journey of attempting to reach out to young professionals by organising such training programmes.

Eminent professors Sakshi Vijay, Akash Gupta and Anjali Chawla explained the theoretical aspects, while eminent Senior Advocates Parag Tripathi, Saurabh Kirpal and Anil Airi discussed the applicability of ADR in and matched theory via-a-viz actual legal practice.

Session  ll was moderated by Ms. Neelam Rathore, Advocate (Vice President), Maadhyam.

Session ll of Part l ADR learning series was conducted on 2nd December, 2023 in the national capital Delhi.
